City denies condo plan request

After much discussion — some of it heated between a petitioner and the city engineer — the Austin City Council on Monday denied an amendment request to an Austin condominium’s development plan.

Roger Derrick, co-owner of the unfinished Fox Pointe development near Wal-Mart, expressed his frustrations, namely with city engineer Jon Erichson, but ultimately was denied by city council, causing Derrick to seriously doubt the project’s future.

“I don’t know how it can (be completed),” Derrick said afterward. “I guess I’m surprised by city council.”

Working off the recommendation of the city planning commission, which had recommended the request be denied last week, the council cited unfinished work and a slow timetable as reasons to deny the amendment.

That amendment called for a few changes to the site’s layout as well as a new road, which Derrick said was crucial to getting more people interested in the condos.

Councilman Jeff Austin said it was “obvious” that the first phase of the project was incomplete and the city should see that part of the deal get done before proceeding.

Derrick has admitted that work has been slower than expected, but said the new road could have really spurred development.

John Dewey, speaking on behalf of Adam and Shirle Dieser, told the council that his in-laws and their neighbors, Jim and Cathy Wegner, deserve to receive what they paid for.

“These are retirees who put their faith into (Fox Pointe),” he said. “It has nothing to do with the city engineer. It has to do with (Derrick) not finishing what he started.”

Mayor Tom Stiehm agreed.

“We have people living out there not getting what they paid for,” he said.
