Austin man found through stolen moped convicted of drug possession

An Austin man has received a stayed prison sentence of one year and one day for possessing over 4 grams of marijuana with intent to sell.
Zane Martin Roberts, 20, was convicted of fifth-degree drug possession with intent to sell Friday in Mower County Court. In lieu of his stayed prison sentence, he will serve five years on supervised probation.
Roberts was initially also charged with two counts of felony theft, driving without a valid license and driving without insurance; those charges were dropped in a plea agreement.
According to a court complaint, the incident took place August 31, 2010, when police received a report of a stolen moped. The owner told police he heard that Roberts was trying to sell a moped that looked similar to the stolen one.
Police came across Roberts driving the moped later that evening and pulled him over for driving without license plates. Roberts, who did not have a valid license, said he was test driving the moped to see if he wanted to buy it. However, the owner arrived and identified it as his own, although it had been repainted, the headlights were broken and the license plates had been taken off, according to the court complaint.
During the traffic stop, officers also found four bags of marijuana in Roberts’ possession, each weighing 1.2 grams. His phone also contained several text messages related to drug sales. Roberts originally told police he planned to smoke the marijuana but not sell it. Later, he said he is the “middle man” between customers and a supplier and receives money and marijuana in exchange for referring people to the supplier, the court complaint states.
