A 23-year-old Austin man who stole a $13 bottle of brandy and led police on a foot chase through backyards and fought with an officer was sentenced Thursday in Mower County Court.
Mayai Arob Shaben Cobai was convicted of fourth-degree assault of a peace officer, a felony. He was sentenced to 12 months in prison, stayed for three years’ supervised probation. Though Cobai is not living illegally in the U.S., he does not have full citizenship and is in Immigration and Customs Enforcement’s custody. ICE will determine if he needs to be deported or placed in some other setting.
Cobai was arrested on Jan. 10 around 4 p.m. on the 300 block of Eighth Street NE after Star Liquor reported that a man had stolen a bottle of liquor.
According to the court complaint, officers found Cobai in a nearby parking lot and chased him on foot and through backyards until he was cut off by another officer. Cobai fought the arrest and tried to punch the officer who took him to the ground, according to the complaint. Officers warned Cobai they would taze him, and after struggling with him more, they did. The complaint also says Cobai would not stand up, was hauled to the squad car, spit at the car and officer and was finally placed in the car with a spit hood.
