Teen sentenced for DWI, spitting on officer

Brandon Michael-Scott Garson, 19, of Austin was sentenced to 15 days in jail and five years of probation for fourth-degree assault on a peace officer-throw/transfers bodily fluids or feces at/on an officer on Thursday in Mower County District Court. He received a concurrent sentence of one stayed year in jail and two years of probation for gross misdemeanor third-degree DWI-refusal to submit to a chemical test.
Another charge of felony fourth-degree assault on a peace officer and charges of gross misdemeanor second-degree DWI-refusal to submit to a chemical test, gross misdemeanor DWI-under the influence of alcohol, misdemeanor obstruction of the legal process and misdemeanor no proof of insurance were dismissed as part of a plea agreement.
According to the court report, Garson struck several vehicles with his 2005 Chevy Equinox in the night hours of Dec. 21 at the intersection of Seventh Street and Second Avenue Southwest. Garson claimed he was going 25 to 30 miles per hour, but a witness said he was going about 60 miles per hour on a city street.
After failing or refusing to take several sobriety tests, Garson was arrested and taken to Mower County Jail.
While there, he became aggressive and was placed in a restraint chair with a spit hood. While being processed for DWI, he spat on an officer several times. He also refused to provide a urine or blood sample.
As part of his probation, Garson must follow 17 conditions, perform 200 hours of community service and pay $110 in fees and fines. He received credit for 15 days served.
