Predatory offender gets prison time after failing to register

Failing to update authorities about moving residences has led to a predatory offender receiving an 18-month prison sentence.

Francisco Luna, 20, of Austin, pleaded guilty on July 14 to predatory offender failing to register, a felony. His plea was part of an agreement with the Mower County Attorney’s Office.

Mower County District Court Judge Jeffrey Kritzer this week sentenced Luna to 18 months in prison with credit for 57 days of time served.

According to court documents, Kritzer agreed to impose a prison sentence six months shorter than sentencing guidelines advised.

In his motion requesting the departure, defense attorney Daniel Donnelly wrote as a reason that Luna’s “conduct in the offense was significantly less serious than the typical conduct involved in commission of the crime in question.”

He also noted the prosecution agreed.

According to the criminal complaint, Luna was arrested May 5 after Austin police confirmed he had moved out of the residence listed on the Minnesota Bureau of Criminal Apprehension Predatory Offender Registration website. He had not updated his residency. He told police he was living at a relative’s home, also in Austin.
