Mallan gets multiple felony charges

Joseph Henry Mallan, 34, of Austin was charged on Wednesday in Mower County District Court with felony domestic assault.
He was also charged in another incident with felony kidnapping-to commit bodily harm/terrorize, felony escape from custody, felony domestic assault, felony false imprisonment-intentional restraint and felony fleeing a peace officer in a motor vehicle.
In both cases, Mallan allegedly victimized his ex-girlfriend.
According to the court complaint, Mallan’s ex-girlfriend told police on April 10 that Mallan had assaulted her about two days prior. She said he was angry because he kept track of the mileage on her car and he believed she was lying about where she had been.
Mallan allegedly grabbed her by the back of the head and threw her onto the bed. The victim said he then held her wrists down and pressed his head into hers, telling her that if she did not stop screaming he was going to do something worse.
When she quieted down, Mallan let her get up, according to the complaint. She told police she waited to report the alleged assault because she was afraid of him and indicated that he previously told her he knew how to hurt her without leaving a mark.
Police were dispatched at approximately 2 a.m. on April 13 to Mallan’s residence to do a probation check after the Department of Corrections received a tamper alert from Mallan’s electronic monitoring device, according to another court complaint. A search of the residence showed no sign of Mallan or the monitoring device. Family members suggested he might be with the victim, but when police went to her residence, she was not home. Her car was also missing.
A friend of the victim told police the victim had gone to Mallan’s residence to get some of her things, according to the report. She said she followed the victim there because she knew Mallan had been violent in the past and had made several attempts to call and text her after she went inside, but got no response.
Police issued an alert to be on the lookout for the victim and the DOC issued a warrant for Mallan’s arrest, according to the complaint. The monitoring device was allegedly found in the 800 block of 11th Avenue Southwest. Police pinged the victim’s cell phone, which indicated it was in the area of Fourth Street Southwest and County Road 28.
At 3:58 a.m., an officer in that area observed a vehicle that matched the description from the alert, according to the complaint. The vehicle allegedly sped up and the officer gave chase, clocking speeds between 64 and 80 mph. The chase ended when the driver bailed out and ran through backyards in the 400 block of 11th Avenue Southwest. The car stopped when its right wheel hit the curb.
The officer found the victim in the passenger seat, according to the complaint. She said that Mallan took her keys when she arrived at his residence and told her to get into her vehicle. When they left the residence, Mallan allegedly used a knife to cut off the monitoring device. She said they went on a drive through the country and he yelled at her about their relationship and that she should have just fixed it. She said she asked him to let her out and that she would walk home.
When asked why she didn’t answer her phone, she said he took it from her and threw it out the window, according to the complaint. The officer later located the phone just to the east of the intersection of County Road 28 and Fourth Street Southwest.
Mallan was allegedly seen fleeing a garage fire on April 13 in an alleyway behind 708 11th Avenue Southwest; however, law enforcement has not indicated that he was involved in the fire.
Early Saturday morning, Mallan was taken to the hospital after claiming he had overdosed and was arrested on Sunday after being discharged.
A review of Mallan’s criminal history shows prior convictions for theft, receiving stolen property, criminal damage to property, issuing dishonored checks, possession of burglary or theft tools, fleeing a peace officer, giving a false report to a peace officer, terroristic threats and criminal sexual conduct with a victim aged 13-15.
He will appear in court again on April 30.
