Felon sentenced to 30 years for sexually assaulting child

Mario Antonio Burciaga, 33, of Austin was sentenced on Friday in Mower County District Court to 360 months in the Minnesota Correctional Facility in St. Cloud for felony first-degree criminal sexual conduct-sexual contact with a child under 13 years of age. He received credit for three years and 10 days served and may have a conditional release after confinement of 10 years.
Judge Kevin Siefken issued the sentence.
Court documents state that Austin police and Mower County Human Services received a report in 2014 that a child under age 5 had been sexually assaulted by Burciaga.
While the victim was only able to disclose some information at the time, the victim was later able to tell more of what had happened in the summer of 2016.
A review of Burciaga’s criminal record shows numerous prior convictions, including assault, terroristic threats, drug possession and harassment-stalking.
Under Minnesota law, 30 years is the maximum amount of time one can serve in prison for felony first-degree criminal sexual conduct-sexual contact with a child under 13 years of age.
In addition to the prison sentence, Burciaga must also pay $20,085 in fines.
