Felon sentenced for weapon, drug possession

Jesse Darell Downer, 29, of Austin was sentenced to 60 months in the Minnesota Correctional Facility in St. Cloud for violent felon in possession of a firearm on Monday afternoon in Mower County District Court. He received credit for 29 days served.

He received a concurrent sentence of 17 months in prison for felony fifth-degree drugs-possess schedule 1,2,3,4-not small amount of marijuana.

Charges of felony receiving stolen property, gross misdemeanor child endangerment, gross misdemeanor introduce contraband in jail and another charge of felony fifth-degree drugs-possess schedule 1,2,3,4-not small amount of marijuana were dismissed as part of a plea agreement reached on March 29.

Downer was arrested on June 13, 2018, after members of the Mower County SIRT Team, Southeast Minnesota Drug Task Force and detectives with the Austin Police Department and Mower County Sheriff’s Office executed a search warrant on his residence in the 1600 block of 16th Street Southwest. Downer was located in the living room. Two other adults, a male and female, and two juvenile boys were also found inside the residence.

Downer told police he did not know why they were there. When asked if he was selling drugs, Downer denied it and said he only had some for personal use.

Police found a bottle filled with a large amount of Xanax pills in the living room. Downer initially told police they were fake and from a movie, then said a friend gave them to him.

Law enforcement found marijuana, pills, various paraphernalia, cash, firearms and ammunition throughout the residence. A stolen Smith and Wesson 9-millimeter handgun and just under a pound of marijuana were located in Downer’s bedroom, which he shared with the female. Downer is prohibited from being in possession of a firearm due to a prior terroristic threats conviction.

More marijuana was found in Downer’s possession when he was searched at the Mower County Jail.
