Two charged with drug crimes

Two men allegedly found in possession of drugs made their first appearances on Monday in Mower County District Court.
Jose Benito Vasquez Castillo, also known as Edwin Jimenez and Jose Benito Vasquez, 31, of Austin was charged with felony third-degree drugs-possess 10 grams or more of a narcotic drug other than heroin.
Ivan Navarrete Jimenez, also known as Navarrete Jimenez and Ivan Rafael Yepez-Jimenez, 25, of Austin was charged with two counts of felony fifth-degree drugs-possess schedule 1,2,3,4-not a small amount of marijuana.
According to the court complaint, a narcotics detective requested assistance from an Austin Police officer in making contact with a Hispanic male, later identified as Castillo, at about 7:47 a.m. on Friday. Castillo had just left an apartment in the 600 block of Second Street Northwest, where the detective was planning a search warrant. The detective advised Castillo was dangerous and might be armed with a firearm.
The officer observed Castillo riding a bicycle and failing to stop at stop signs. The officer activated his emergency lights as Castillo rode into the Freedom Valu Center parking lot. He identified himself and told Castillo he stopped him for failing to stop at stop signs, but Castillo claimed to not speak English or have any identification.
Because he had been told Castillo might have a firearm, the officer told Castillo to remove his backpack, then to remove his hands from the backpack when he unzipped it and started to reach in. He also told him to remove his hands from his sweatshirt front pocket after setting down the backpack.
The officer informed Castillo that he was being detained and told him to turn around and place his hands behind his back. Castillo tensed up and attempted to pull away as the officer tried to handcuff him. The officer told Castillo he was under arrest, but he continued to resist and was finally restrained when the narcotics detective arrived to assist.
Castillo was searched and was found to be in possession of a white plastic container containing 2.8 grams of methamphetamine (which tested positive after a NIK test) and a meth pipe. A small pipe and a small sale bag of marijuana was later located at the Mower County Jail. A pay stub with the name “Edwin E. Jimenez” was also located.
A search warrant was obtained for the backpack and police found 15.54 grams of methamphetamine and small baggies for packaging.
At about 10:36 a.m. on Friday, law enforcement executed a search warrant at the apartment. Police announced their presence and breached the door after no one answered. A narcotics detective spotted Jimenez coming out of the bathroom, where the toilet had just been flushed, and secured him in handcuffs.
Police located a 3.02-gram bag of methamphetamine on an air conditioner, a 0.42-gram bag of methamphetamine under a bed and a 2.47-gram bag of cocaine in a bedroom closet, all of which tested positive with a Nartec Kit. They also found meth pipes, a digital scale and other drug paraphernalia as well as methamphetamine residue on the toilet paper above the toilet and an empty bag with residue inside the toilet paper roll. It appeared that Jimenez had flushed the bags contents before police entered.
Both will appear in court again on Aug. 19.
