An Albert Lea teen accused of using a brick to smash in the skull of his family’s Chihuahua was sentenced Monday to between 90 and 120 days in an out-of-home placement.

Seventeen-year-old Omar Rodriguez pleaded guilty in Freeborn County District Court to one felony count of overworking or mistreating an animal for killing the dog on the porch of his family’s home on Oct. 13.

Rodriguez, who had been placed at a secured juvenile detention facility in Red Wing since late October, will complete the placement at the Prairie Lakes Youth Program in Willmar.

The order came from Freeborn County District Judge Steve Schwab in juvenile court, which was open to the public because Rodriguez was over 16 and charged with a felony.

Assistant Freeborn County Attorney Erin O’Brien said the sentence took into account Rodriguez’s past records and a psychological evaluation.

O’Brien declined to comment about the outcome.

Court documents state Albert Lea police were called to Rodriguez’s home, on the 800 block of Madison Ave., after a family member reported the incident to police.

The dog reportedly was found laying next to a cinder block with a large pool of blood underneath it. The teenager had reportedly set the dog on the cinder block and then used a paver brick to strike it in the head.

O’Brien and Freeborn County Probation Officer Darren Welsh said in a previous court hearing that Rodriguez had a history of “genuine, crazy, displaced rage” directed at his family and said there were also concerns about possible controlled substance use.

Rodriguez told police in an interview that he has “unpredictable behavior.”
