The man who was arrested for felony forgery after failing the Austin Police Department’s alcohol compliance check was sentenced to three years of supervised probation in Mower County Court Friday.

Elfego Olvera-Reyes, 22, was convicted of one count felony forgery. He must complete 40 hours of community service and cooperate with U.S. Immigrations and Customs Enforcement as conditions of his probation.

Olvera-Reyes was initially arrested after Austin police performed an alcohol compliance check at El Mariachi Mexican restaurant, Olvera-Reyes’ place of employment.

Olvera-Reyes failed to check the ID of the person performing the compliance check and was initially charged with two other counts of felony forgery and serving liquor to a minor; however, those three counts were dismissed when he pleaded guilty to one count of felony forgery.

The man identified himself as “Daniel Luna” to the person performing the compliance check and as “Joe Luna” to the officer. His manager told police Olvera-Reyes goes by the name of Joe Luna.

When police went to Olvera-Reyes’ home, located at 403 2nd Street Northwest Unit 3 in Austin, he presented to them a Mexico consulate card and Mexico federal voter card under his real identity.

Police found a Qwest bill and W-2 for “Joe Daniel Luna” at the residence, as well.

Olvera-Reyes later admitted that he was born in Mexico and came to the United States illegally four years ago. He said he bought a fake social security card and Minnesota driver’s license from “a guy” in Austin for $1,000, but said he could not remember the man’s name.
