A Hollandale man charged with having two wives was sentenced to a year of unsupervised probation Friday in Freeborn County Court.

Wayne Allen DeMay, 41, entered an Alford plea to one count of felony bigamy. In an Alford plea, a defendant admits there is enough evidence to convict but does not specifically admit guilt.

DeMay married Constance Ann Flim May 1, 2010, though he never divorced Brigette Ann Beaumont, whom he married Feb. 19, 2003, according to court files and marriage records.

The DeMay-Flim application for a marriage license showed the couple marked that DeMay had never been married. Records from Madison County, Ky., say otherwise.

Last November, Beaumont — who carried her spouse’s name — approached Freeborn County authorities after she discovered her husband had remarried, according to court files.

She told authorities DeMay left 26 days after their marriage and had not been heard from since. She tracked him down because she wanted a divorce so she could remarry.

In court Friday, Freeborn County Attorney Craig Nelson said the divorce has since been finalized and that DeMay’s marriage to Flim was not legal.

Freeborn County District Court Judge Steve Schwab sentenced DeMay to one year of unsupervised probation and stated if DeMay violated his probation he could face 30 days in jail. He must also pay $80 in court costs.
