An Austin man charged with assault for kicking his brother in the head after passing gas pleaded not guilty Thursday in Mower County Court.
Hector Estrada, 33, pleaded not guilty to felony felony domestic assault.
Police arrested Hector Alonzo Estrada, 33, at a McDonald’s in Austin shortly after they received the call. Estrada’s brother said Estrada kicked him in the head and left through a back door. Police followed footprints in the snow for several blocks to find Estrada.
Past acts warrant the felony charge. Estrada was convicted of gross misdemeanor assault and interfering with a 911 call last May and faces past charges for violating a no contact order.
Estrada claims he did not assault his brother, and that his brother only fell, according to the court complaint.
