Glenville man pleads not guilty to porn charges

A Glenville man pleaded not guilty in Freeborn County District Court on Monday to taking sexually explicit photos of a young girl and then sending them out online.
Brandon Davis Franksain, 28, pleaded not guilty to three charges: using minors in sexual performance or pornographic work, disseminating pornographic work and possessing pornographic work.
According to court records, the images were allegedly found on Franksain’s cellphone in October. He had reportedly been sending the images via a chatting website.
During the interview with Albert Lea detective Frank Kohl in January, Franksain reportedly admitted to taking photos of the girl and sending them on a messaging site. The court records say he traded child pornography pictures with another person on the site.
Franksain appeared in custody Monday for a brief hearing, in which his public defender Kevin Riha requested a copy of the interview conducted by Kohl and his client. Riha also invoked Franksain’s Sixth Amendment right to a speedy trial within 60 days.
Franksain remains in the Freeborn County jail on an unconditional bail of $100,000 or unconditional bail of $25,000. Conditions include having no contact with the victim, remaining law abiding, having no contact with people under 18 and obtaining permission before leaving the state.
His most serious charge, of using minors in sexual performance or pornographic work, carries a maximum penalty of 10 years in prison or a $20,000 fine.
