Austin resident charged in Freeborn for sexual assault

A 29-year-old Austin man was charged in Freeborn County District Court on Tuesday with sexually assaulting a 13-year-old girl twice during the summer of 2012.

Joseph Henry Mallan faces two counts of first-degree criminal sexual conduct and two counts of second-degree criminal sexual conduct tied to the allegations.

The first assault reportedly took place at the KOA Kampground east of Hayward and allegedly involved sexual intercourse in a trailer.

The second assault reportedly took place in a cabin near Moscow and reportedly involved inappropriate touching.

Freeborn County District Court Judge Ross Leuning on Tuesday ordered Mallan be held in the Freeborn County jail on a $75,000 conditional bail.

Mallan is next slated to appear in court Nov. 14.

First-degree criminal sexual conduct carries a maximum penalty of 30 years in prison and a $40,000 fine.
