ROCHESTER — A former top executive at Mayo Clinic has resigned from a Mayo competitor as part of a settlement over allegedly stolen trade secrets.

Minnesota Public Radio News reports Mayo and Quest Diagnostics reached an agreement in Mayo’s lawsuit against Dr. Franklin R. Cockerill III.

In the lawsuit filed in October, Mayo alleged Cockerill was secretly hired by Quest but continued to work as president and CEO of Mayo Medical Labs so he could steal Mayo trade secrets.

As part of the agreement, Cockerill has resigned from Quest and Quest has filed a motion to withdraw from the suit.

Mayo is not pursuing any claims against Quest. But the clinic continues to pursue remaining claims against Cockerill to protect confidential trade secrets.

Cockerill contends he was not subject to any non-compete agreements after leaving Mayo.
