RED WING— Attorneys for a Minnesota state trooper say criminal charges resulting from a deadly crash in Cannon Falls should be dismissed or a new trial ordered because of misconduct on the part of prosecutors.

Scott Reps’ lawyers argue the rules were not followed during grand jury proceedings and that prosecutors went off the record during the proceedings. Reps’ statement to the State Patrol is also being challenged.

Reps is charged with two felony counts of second-degree manslaughter in the July 4, 2014 crash that killed 78-year-old Norman Scott and his 79-year-old wife, Geneva Scott.
