Burglar receives 20 years probation

A 23-year-old man who broke into a home and allegedly fought police was sentenced Thursday to 20 years of probation.

Marvin Perez, of Austin, was convicted of felony first-degree burglary of an occupied dwelling. Other charges of obstructing the legal process by resisting arrest, another first-degree burglary charge, and a charge of fleeing an officer were dismissed.

Perez was sentenced to 20 years probation and 180 days of local confinement. He received credit for 138 days served. If he does not follow probation, he could serve 27 months in prison.

Homeowners discovered Perez in their home at the 700 block of Second Avenue Northwest before 3 a.m. on July 26 after he snuck in through a bedroom window. One of the homeowners managed to drive Perez away.

Officers investigating the burglary heard the suspect break a tree branch in the backyard and later spotted him lying down in an attempt to hide from police. After a foot chase, Perez gave himself up when he heard Austin’s police K-9 unit barking.

Yet Perez attempted to resist arrest when he tried to kick and head-butt officers while he was taken into custody. He also refused to get into a squad car. Perez was taken to Mayo Clinic Health System in Austin before he went to jail for a cut on his face during the scuffle with officers.
