Austin man pleads guilty to assaulting an officer

Adelaido Hernandez Rosales, 34, of Austin pleaded guilty to felony fourth-degree assault on a peace officer as part of a plea agreement on Monday in Mower County District Court. Charges of gross misdemeanor obstructing the legal process-resisting arrest and misdemeanor domestic assault will be dropped at sentencing.

According to the court report, officers responded to a domestic disturbance call at 1:08 a.m. on May 21 in the 1900 block of Third Avenue Northeast. A woman at the residence told police she had been arguing with Rosales, who was intoxicated. She said he was “begging “ to fight and that he got violent when he was drunk.

When an officer tried to speak with Rosales, he told him not to touch him. A female officer then offered to speak with Rosales. When Rosales spoke to the officer, he slurred his speech and had trouble explaining what happened. The officer asked him how to spell his full name since he had no identification, to which Rosales was somewhat noncompliant.

After speaking to the woman, the officers decided to arrest Rosales. When the female officer approached him to arrest him, Rosales tensed up and pulled away. The male officer tried to assist in the arrest, but Rosales kept pulling away and was taken to the floor. Rosales continued to resist and scratched the male officer on the right side of his face and his right eye. The officers had to use a chemical irritant and a Taser to subdue him.

Rosales is scheduled for sentencing on Jan. 19.
