Man charged with sexual assault

Devontay Latreze Garrett, 24, of Austin was charged on Tuesday in Mower County District Court with felony fourth-degree criminal sexual conduct – force or coercion, misdemeanor fifth-degree assault-inflict or attempt bodily harm and misdemeanor fifth-degree assault-fear of bodily harm or death.

According to the court complaint, officers were dispatched at 1:17 a.m. on Sunday to a residence in the 1600 block of 12th Street Southwest. They made contact with the alleged victim, a woman that said Garrett assaulted her in a vehicle outside a residence in the 2000 block of Fifth Avenue Northeast. She was shaking and complained about pain in her neck.

The alleged victim told the police Garrett had picked her up from work and they went to the 12th Street Southwest residence with some other people to “hang out.” Afterward, they went to the Fifth Avenue Northeast residence, but the victim wanted to go back to 12th Street Southwest to return a car. Everyone except for Garrett, who was on the phone, and the victim exited the car. Garrett then stepped out briefly, ended his phone conversation, got back in the car and allegedly yelled at the victim to get in the back seat.

She said Garrett then got out of the car, pulled her out of the driver seat and forced her into the back seat, according to the complaint. She said she was able to get a Snapchat message to a friend asking for help, but he then took her phone. When she tried to retrieve the phone, he allegedly strangled her and told her, “As long as you do what I want you to do, I won’t hurt you.” He allegedly continued to strangle her, “slamming” her head against the door, and sexually assaulted her. She said it lasted from three to five minutes before another woman opened the car door, allowing her to get out and run down the street.

Officers found Garrett asleep and intoxicated at the Fifth Avenue Northeast residence, according to the complaint. They found that he was wanted on an arrest warrant for violating a domestic abuse order of protection in Hennepin County.

A review of Garrett’s criminal history shows prior convictions for domestic abuse and theft.

Garrett will appear in court again on March 12.
