A charge of misdemeanor fourth-degree criminal damage to property will be dismissed at the sentencing.

Barclay was charged in August after a woman said he, along with an adult male and a juvenile male, had damaged items in her apartment. She said they believed her daughter had damaged the property of someone they knew.

When police arrived at her apartment in the 100 block of Second Street Southeast in Austin, there was a crowd of people outside yelling at each other and getting ready to fight, according to court documents. Barclay, along with the two other males the woman accused, were in the crowd. The officer spoke with the adult male, who said Barclay and the juvenile male had gone into the woman’s apartment.

The officer spoke with Barclay, who said the juvenile male kicked in the door and they had poured “bong water” on the floor. He said it was in retaliation for the woman’s daughter damaging someone’s vehicle.

The lock on the door was broken.

Barclay has a previous conviction for giving a peace officer a false name.

He will be sentenced on June 29.
