Elton Flomo Tolbert, 18, of Austin was charged on Monday in Mower County District Court with felony domestic assault by strangulation and misdemeanor domestic assault.

According to the court complaint, police responded at 3:40 p.m. on Friday to a domestic disturbance in the 900 block of Fifth Street Northwest. They met with a juvenile male who said Tolbert assaulted him for moving a pot on the stove.

The alleged victim said Tolbert punched him in the face, then punched and kicked him in the groin, according to the complaint. Tolbert then allegedly got behind him and strangled him for 15-30 seconds, using his leg to prevent him from escaping.

Officers observed injuries on the juvenile’s neck and torso, according to the complaint.

Tolbert denied strangling the juvenile, allegedly saying that he only punched him in the stomach to get him away from him and using his arms to restrain him around the chest.

A review of Tolbert’s criminal record shows prior convictions for public urination and DWI.

Tolbert will appear in court again on May 10.
