State hosting meeting to discuss S. Court remote sales tax decision; Will announce date of tax enforcement for remote sellers July 25

The Minnesota Department of Revenue (MNDR) will host and participate in an emergency governing board meeting for the Streamlined Sales Tax (SST) Governing Board on July 19 and 20, 2018 at its office in St. Paul. The SST Governing Board will meet to discuss implementation of remote sales tax collection authority in light of the United States Supreme Court’s decision in South Dakota v. Wayfair.
The Court’s decision allows states like Minnesota to require remote sellers with no physical presence, such as online sellers or mail-order catalogs, to collect and remit the applicable sales or use tax on sales delivered to locations within their state.
The Governing Board will convene an open meeting on Thursday, July 19, 2018, from 1– 5 p.m. The department encourages individuals and businesses with interest in the implementation of the Wayfair decision to participate in the open meeting.
The MNDR has been analyzing the Court’s decision to identify how it affects Minnesota, remote sellers, and marketplace providers. The department will announce its expectations for compliance with Minnesota law on July 25, 2018.
The July 25 announcement will provide remote sellers and marketplace providers with the date Minnesota will require them to collect and remit applicable sales or use tax on sales delivered into the state.
“We will work with our customers to ensure fair, efficient, and transparent implementation of this decision,” said Revenue Commissioner Cynthia Bauerly. “We look forward to hearing more from affected businesses during the public meeting on July 19 about how we can best provide the information and services our customers need to meet Minnesota sales and use tax obligations.”
