Fargo murder suspect arrested in Rose Creek: Alleged victim suffered multiple gunshots

A suspect in a Fargo, North Dakota, homicide was arrested Monday evening in Rose Creek.

According to Mower County Senior Sgt. Investigator Steve Sandvik, the Clay County Sheriff’s Office and Fargo Police Department alerted local law enforcement that a wanted fugitive might be hiding in Mower County. The Mower County Sheriff’s Office and Austin Police Department SERT Team assisted U.S. Marshals in executing a search warrant on Monday evening at a residence in the 200 block of Elm Street in Rose Creek. They arrested Miguel Jay Cooley Sr., 44, of Moorhead, who was initially non-compliant but later surrendered.

Sandvik said the residence belonged to distant relatives of Cooley. U.S. Marshals listed the residence as a possible hiding place for Cooley.

Cooley is wanted in conjunction with an early Sunday morning murder that took place at the McDonalds Restaurant located at 905 Main Ave. in Fargo.

According to a press release from the Fargo Police Department, officers responded at 5:33 a.m. to a medical-assist at the McDonalds. Once on scene, officers located a male in his 20s, later identified at Gabriel Perez, laying in the parking lot with multiple gunshot injuries. The victim was pronounced dead at the scene.

Fargo Police officers and detectives began investigating the incident, and determined the victim was sitting on a curb next to the building when a dark blue or black Chevy Trailblazer entered the parking lot at a high rate of speed, the press release said. The driver pulled up next to the victim and shot the victim multiple times. The victim got up and ran westbound in the parking lot, but collapsed after a short distance. The suspect drove out of the parking lot and continued eastbound on Main Avenue.

Cooley is currently being held at the Mower County Jail waiting to be processed and transported to Fargo.
