Calvin Curtis Horton, 39, of Minneapolis was sentenced on Thursday in Mower County District Court to 27 months in the Minnesota Correctional Facility in St. Cloud for felony domestic assault. He received credit for 93 days served.
Judge Christa M. Daily issued the sentence.
Horton was arrested on July 30, 2016, after police were called to the 900 block of 11th Avenue Southwest. Court documents state they found two women standing outside a residence.
One woman, the victim, told police that she was in bed at her residence in the 1000 block while Horton was playing his music. She said when she told him to turn the music down, Horton, who was intoxicated, came into her room, pulled the blanket off of her and knocked something over. He then started grabbing and pulling her and scratched her on the neck when she told him to leave. She then left the residence and came to her neighbor’s house.
An officer observed redness on the victim’s neck and scratch marks on the back of her forearm, the complaint states.
Officers found Horton at the victim’s residence, yelling down the street at her and playing music on his phone, according to the complaint. He initially refused to speak with the officers or shut off his music. When he did speak to the police, he told them he and the victim had gotten into an argument and she had gone down the street.
A review of Horton’s criminal record shows prior convictions for assault.
