An Austin woman accused of breaking into an apartment and attacking a couple last fall was sentenced to five years of probation Thursday.

Mower County judge Donald Rysavy also ordered that Nyaluak Reast Dak, 30, perform 40 hours of community service via the state’s Sentence to Service program.

Dak was sentenced on a felony-level aid and abet burglary charge, to which she plead guilty in December. A felony first-degree burglary charge was dismissed in the case.

According to a court complaint, the incident occurred on the night of Oct. 18 at an apartment on 204 11th Ave. NW.

Dak and Josephine Kong Thor, 23, broke into a room at around 6:40 p.m. and attacked a 28-year-old man and his 35-year-old wife.

Thor also yelled death threats at one of the residents, the complaint states.

The man and woman were able to get the two attackers out of the room. Dak and Thor then went outside and at least one of them began throwing rocks at the room’s balcony.

The complaint states that Dak and Thor returned to the door again that evening, banging on it and yelling at the two inside.

The man and woman called police and Dak and Thor again left.

Dak was later arrested in a different room at the apartment. According to the complaint, she yelled and waved her arms wildly during the arrest.

The 28-year-old man identified Dak as one of the two intruders.

Thor was later tracked down at home and said she had nothing to do with the attack. Because she was watching several children, police made no arrest, the complaint notes.

During police questioning, Dak said the attack was Thor’s idea and that she had gone with. She said she tried to hold Thor back when she was banging on the door.

Thor was subsequently arrested, and officers were assigned a welfare check on the children at the 58505 221st St. property, where both women live.

Thor, who pleaded guilty to felony second-degree burglary in January, awaits sentencing next month.
