Offender sent to prison Friday for 7 years, must register for life

A local man was sent to prison Friday for 7 1/2 years and must now register as a sex offender for the rest of his life.

Erasmo Ubaldo Marcos, 42, of Austin, was convicted of felony second-degree criminal sexual conduct — multiple acts with a person younger than 16. He was given credit for 116 days served in jail. As part of a plea agreement, five other felony criminal sexual conduct charges were dropped.

Marcos’ wife, Angela Kay Ubaldo, 33, is also charged in the case for trying to cover up her husband’s actions. According to court complaints, Ubaldo notified Marcos earlier this year that police were going to arrest him for criminal sexual conduct. Marcos had sex with the victim several times during the last year until the victim reported it in April, after which Marcos was finally arrested.

Ubaldo pleaded guilty on July 13 to aiding an offender, a felony, and gross misdemeanor neglect of a child. She has yet to be sentenced. While many predatory offenders must register as an offender for a minimum of 10 years, Ubaldo’s orders say he must register for life, meaning his whereabouts, jobs and vehicles must all be tracked by the state.
